Terms of Service

1. Acceptance
By creating an account or using mychipserver.com ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. The Service
mychipserver.com provides remote access to embedded development hardware including microcontrollers and development boards ("Devices"). Features include: device reservations, firmware flashing, GDB debugging sessions, OpenOCD command execution, UART and logic analyzer data streams, and team management tools.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must enable two-factor authentication when prompted. Sharing account credentials is prohibited.
We reserve the right to refuse, suspend, or terminate accounts at our discretion, including accounts used for unauthorized purposes.
4. Acceptable Use
You may only use Devices for lawful embedded development and research purposes. You must not:
- Attempt to access Devices reserved by other users
- Interfere with or disrupt the platform infrastructure
- Upload malicious firmware intended to damage hardware
- Exceed your reserved time slot or reservation quota
- Use the platform to develop weapons, surveillance systems, or other harmful technology
- Reverse-engineer or extract proprietary system software from connected hardware
- Resell, sublicense, or transfer access to third parties without written consent
We monitor device sessions for compliance with these Terms. Violations may result in immediate account termination.
5. Reservations & Quotas
Device access is governed by reservations. Reservations are subject to availability. You may cancel a reservation before the start time. No-shows or late cancellations within 15 minutes of the start time may count against your monthly quota.
Each subscription plan includes a monthly device-hour quota. Unused hours do not roll over. Exceeding your quota will prevent new reservations until the next billing period.
6. Organizations & Multi-Tenancy
Organizations ("Tenants") may enroll their members on our platform under a single subscription. Organization admins are responsible for managing member access, roles, and quotas. We are not responsible for how organizations manage internal permissions or disputes between members.
7. Intellectual Property
Firmware, code, and other content you upload to the Service remains yours. You grant us a limited license to store and transmit your content solely to operate the Service. We do not claim ownership of your firmware or intellectual property.
The mychipserver.com platform, branding, and software are owned by MyChipServer, Inc. You may not copy, modify, or distribute our software.
8. Uptime & SLA
We target 99.5% monthly uptime for the platform. Scheduled maintenance windows will be announced at least 48 hours in advance. We are not liable for downtime caused by third-party services (Vercel, Supabase, Clerk), physical hardware failures, or events outside our control.
9. Limitation of Liability
To the maximum extent permitted by applicable law, MyChipServer, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or hardware damage, arising from your use of the Service.
Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless MyChipServer, Inc. and its employees from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or misuse of the Service.
11. Termination
You may close your account at any time. We may terminate or suspend your account for violations of these Terms, non-payment, or any reason with 30 days notice (except in cases of serious violations, which may result in immediate termination without notice).
Upon termination, your data will be retained for 30 days then deleted, except where retention is required by law.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
13. Changes
We may update these Terms. We will notify you by email at least 30 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
